In certain situations, a speaker may say something defamatory without being liable because of the existence of a qualified privilege. 1.Reports of Public Proceedings 2. Publication to one acting in public interest 3. Fair Comment and criticism The defendant bears the burden of proving that a privilege exists. If the privilege is qualified, the plaintiff then bears the burden of proving that the privilege has been lost through excessive publication or actual malice.
